Terms and conditions

Fotini is a service operated by Augusto Sanchez Cardarelli ("we", "us"). By creating an account, creating a roll or joining one, you enter into an agreement with Augusto Sanchez Cardarelli and accept these terms. If you do not agree, please do not use the service.

Continued use of Fotini means you accept these terms and any updates we publish on this page. You must have the legal age required in your country to enter into a contract, or the authorisation of your legal representative. If you use Fotini on behalf of an organisation, you confirm you have authority to bind it.

Fotini is a shared digital disposable camera for events. The host creates a roll, sets how many photos each guest can take, how many guests can join and when the photos are revealed. Guests join with a code or QR, without downloading any app, and the photos stay hidden until the reveal moment chosen by the host.

You are responsible for keeping your credentials confidential and for all activity carried out from your account. The information you give us must be accurate and kept up to date. Tell us immediately if you detect unauthorised use.

You may not use Fotini for:

• Illegal activities or activities that infringe third-party rights.
• Fraud, spam or impersonation.
• Uploading content that infringes intellectual property rights.
• Uploading sexual content involving minors, extreme violence or content that promotes hate.
• Photographing people without their consent where the law requires it, or sharing images of others in private contexts without authorisation.
• Interfering with the security of the service: malware, vulnerability scanning, automated scraping, reverse engineering or circumventing technical limits.
• Reselling, redistributing or sublicensing the service.

Photos uploaded to a roll remain the property of whoever takes them. You grant us a limited licence to host, process and display that content for the sole purpose of providing the service (for example, storing photos and showing them in the roll gallery). We may remove content that breaches these terms.

Fotini's software, design, documentation and trademarks belong to Augusto Sanchez Cardarelli. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you purchased. No other rights are transferred to you.

We work to keep Fotini running well, but we do not guarantee an uninterrupted, error-free or always-available service. To the extent permitted by law, the service is provided "as is", without implied warranties of merchantability or fitness for a particular purpose.

Fotini is charged as a one-off payment per event, based on the guest limit you choose. There are no subscriptions and no automatic renewals.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund conditions are governed by the Paddle Buyer Terms. See also our refund policy.

We may suspend or terminate access to the service in case of material breach of these terms, non-payment, fraud or security risk, or repeated or serious violations of the usage rules. When access ends, you may request a copy of your photos within a reasonable period before they are deleted.

To the extent permitted by law, our total aggregate liability is limited to the amount paid for the service in the six months prior to the event giving rise to the claim. We are not liable for indirect, special or consequential damages, including loss of profits, data or reputation. None of this excludes liability for fraud, wilful misconduct, death or personal injury where the law does not allow it.

You will hold us harmless against third-party claims arising from the content you upload, from illegal use of the service or from breach of these terms.

We may update these terms. If a change is material, we will let you know by email or within the service before it takes effect.

These terms are governed by the laws of Augusto Sanchez Cardarelli's jurisdiction and disputes will be submitted to its competent courts. For any question, write to augusto.sanchez.cardarelli@gmail.com.
